PREAMBLE


These General Terms and Conditions of Sale are concluded on the one hand by the company DANUNIVERSE ENTERTAINMENT, a SAS with variable capital, registered with the Paris Trade and Companies Register under number 932 640 725, whose registered office is located at 8 rue de Gravelle, 75012 Paris, France, intra-community VAT number FR61932640725, hereinafter referred to as "Therapy by Dan" or "the Seller", and on the other hand by any natural or legal person wishing to make a purchase via the website www.therapy-bydan.com, hereinafter referred to as "the Client".

The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in connection with the online sale of products offered under the Therapy by Dan brand on the website www.therapy-bydan.com.

Any order placed on the website implies the Client's full and complete acceptance of these General Terms and Conditions of Sale.

DANUNIVERSE ENTERTAINMENT reserves the right to modify these General Terms and Conditions of Sale at any time. The applicable General Terms and Conditions of Sale are those in force on the website on the date the order is placed by the Client.


ARTICLE 1 • PURPOSE

These General Terms and Conditions of Sale govern the contractual relationship between DANUNIVERSE ENTERTAINMENT, operating the Therapy by Dan brand, and the Client.

They cover the various stages of the sale: product presentation, order placement, payment, shipping, delivery, right of withdrawal, returns, refunds, and customer service.

ARTICLE 2 • PRODUCTS

The products offered for sale are those presented on the website www.therapy-bydan.com on the day of the Client's consultation.

Each product is accompanied by a descriptive sheet detailing its price, main characteristics, content, visuals, available editions and, where applicable, specific terms of sale, particularly in the case of pre-orders.

Product visuals are presented for illustrative purposes only. Slight differences may exist between the photographs displayed on the website and the product received, particularly due to screen resolution, display settings or minor production variations.

DANUNIVERSE ENTERTAINMENT undertakes to deliver products that comply with the description displayed on the website, within the limits of available stock.

In the event of a product being unavailable after the order has been confirmed, the Client will be informed by e-mail as soon as possible. The Client may then choose between a refund for the unavailable product or an alternative solution offered by customer service.

 ARTICLE 3 • PRICE AND PAYMENT

Product prices are indicated in euros, all taxes included, excluding delivery costs.

Delivery costs are indicated to the Client before final validation of their order. They are at the Client's expense and are added to the price of the products ordered.

Accepted payment methods may include: credit card, Visa, Mastercard, American Express, PayPal, Shop Pay, Klarna or any other payment method offered on the website at the time of order.

DANUNIVERSE ENTERTAINMENT reserves the right to modify its prices at any time. However, products will be invoiced based on the prices displayed at the time the order is validated by the Client.

In the event of a clearly erroneous, derisory or inconsistent price display, DANUNIVERSE ENTERTAINMENT reserves the right to cancel the order concerned. The Client will then be informed as soon as possible and may, if they wish, place a new order at the corrected price.

ARTICLE 4 • SHIPPING

  1. Standard Delivery Time: The standard delivery time is determined by the selected carrier and may vary depending on their policy and efficiency. While we strive to provide accurate estimates, the times indicated in business days are only approximations and may be subject to variations due to unforeseen circumstances.

  2. Pre-orders: For pre-order items, standard delivery times do not apply. Customers will be informed of estimated delivery times specific to their pre-order as soon as this information is available.

  3. Delivery Zones: We offer shipping both in France and internationally. The choice of carrier determines the available delivery zones. It is the customer's responsibility to verify if the chosen carrier covers the desired delivery zone.

  4. Customs Fees and Additional Taxes: For deliveries outside Europe, customs fees and additional taxes may apply. These fees are the responsibility of the customer and vary according to the destination country. Customers are advised to inquire about local customs policies to avoid surprises.

  5. Carrier's Responsibility: Once the package is handed over to the carrier, the responsibility for shipping lies with the carrier. We undertake to select reliable carriers, but in the event of delays, damage or loss during transit, the responsibility reverts to the carrier. We will nevertheless assist customers in resolving such issues to the best of our ability.

Customer Responsibility for Package Collection and Non-Refund Policy:

  1. Collection Responsibility: It is the customer's responsibility to collect the package within the time limit indicated at the selected delivery or pick-up point. The customer is required to track the delivery status and ensure the package is collected within the allotted time.

  2. Delivery Notifications: The customer will receive notifications indicating that the package is ready for collection. It is the customer's responsibility to respond to these notifications and take the necessary steps to collect the package.

  3. Collection Time Limit: The customer has a specified period (generally 10 business days) to collect their package. After this period, the package will be returned to the sender.

  4. Consequences of Non-Collection: In the event of non-collection of the package within the time limit, return and handling fees will be charged to the customer. Furthermore, if the package is returned to the sender, no refund will be issued if the product is damaged or if additional costs are incurred.

  5. Damaged Products on Return: If a returned product is received in damaged condition, it is considered non-refundable and non-exchangeable. The customer assumes responsibility for damages incurred during the return process.

  6. Carrier Fees: Any additional fees required by the carrier for the return or collection of the package will be charged to the customer.

  7. Acceptance of Terms: By placing an order, the customer acknowledges having read and accepted these terms and conditions. It is the customer's responsibility to understand and comply with these requirements.

ARTICLE 5 • RIGHT OF WITHDRAWAL
In
accordance with the provisions of the Consumer Code, the consumer Client has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to provide a reason for their decision.

To exercise their right of withdrawal, the Client must contact customer service by e-mail at the following address: support@therapybydan.fr.

After validation of the request by customer service, products must be returned in their original packaging, complete, unused, undamaged and in perfect resalable condition.

Returns must be sent to the following address, after prior validation of the request by our customer service:

For any exchange or return in accordance with the provisions of Article L 121-16 of the Consumer Code, the following procedure must be fully respected:

  1. The client must submit a request by e-mail to the following address: support@therapybydan.fr
  2. An email validation will be sent to the Client, including a return confirmation with the return slip to be attached to the package.
    1. Card games must be returned in their original packaging and in perfect resalable condition, with any accessories, to the following address: DANUNIVERSE ENTERTAINMENT - 71 Étienne Dolet 94140 Alfortville. Any damaged, used or incomplete product will be refused.
  3. For all returns, please keep proof of shipment and ensure that the return is properly packaged to avoid any damage.

Subject to compliance with the above conditions, Therapy will refund the total amount of the order to the Client. The refund will be made directly to the customer's bank account within a maximum of 30 days from the receipt of the products by Therapy.

ARTICLE 6 • PERSONAL DATA

As part of its activity, DANUNIVERSE ENTERTAINMENT may collect certain personal data from the Client, particularly when creating an account, placing an order, making a payment, during delivery, customer service, or when subscribing to marketing communications.

The data collected is necessary for managing orders, delivering products, processing payments, customer follow-up, after-sales service, and, where applicable, sending commercial information if the Client has consented.

Personal data is neither sold nor transferred to third parties for commercial purposes. However, it may be transmitted to technical, logistics, payment, or delivery service providers when necessary for the execution of the order or the proper functioning of the site.

The Client has a right of access, rectification, opposition, deletion, and limitation of the processing of their personal data, under the conditions provided by the applicable regulations.

ARTICLE 7 • COOKIES
To efficiently process the Client's order and to better understand their needs in order to personalize the services offered on the Site, Therapy uses cookies. A cookie is a small file stored on the Client's computer hard drive, which serves to identify their visit to our Site.
Cookies retain various information during the Client's visit to the Site, such as their identity (known through their email address and password) and the content of their shopping cart. This information is kept for 30 days after the Client logs out, before being permanently deleted.
If the Client wishes to object to the use of cookies, they can configure their browser accordingly. However, this will result in the loss of any personalization of the service offered on our Site.

ARTICLE 8 • LIMITATION OF LIABILITY
Placing an order on the Therapy Website implies knowledge and acceptance of standard Internet network procedures. This includes technical performance, response times, connections, information transfers, risks of interruption, risks of virus contamination, and, in general, all risks associated with the use of the Internet network.
Therapy cannot therefore be held responsible for any direct or indirect damage resulting from improper use or incidents related to computer use, Internet access, maintenance, or malfunctioning of servers, telephone lines, or any other technical connection. Access to the Site by the Client is at their own risk.

ARTICLE 9 • FORCE MAJEURE
Therapy will not be held responsible for the total or partial non-performance of its obligations relating to the order placed by the Client, if this non-performance is due to an event constituting a case of force majeure as defined by current legislation.
In such a situation, Therapy will inform the Client of the occurrence of this event within 3 working days of its occurrence, by e-mail.
If the case of force majeure persists beyond a period of one month, the order will be cancelled. If applicable, a refund will be made to the credit card used to place the order, within a maximum of 30 days.

ARTICLE 10 • APPLICABLE LAW AND JURISDICTION
If any of the terms of these General Terms and Conditions of Sale of Therapy is declared null, illegal or unenforceable by court decision, the other provisions of the General Terms and Conditions of Sale shall remain fully in force.
The General Terms and Conditions of Sale are governed and interpreted in accordance with French law.
In the event of a dispute, the client will first contact Therapy to find an amicable solution. Failing an amicable agreement, the Commercial Court of Paris will have sole jurisdiction.

ARTICLE 11 • LEGAL NOTICES

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the Client is invited to contact customer service first at the following address: support@therapybydan.fr in order to seek an amicable solution.

Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with the applicable common law rules.
